  1. 2.  Richard Dean McCuistian was born on 19 May 1889 in Hays County, Texas (son of Francis Marion McCuistion and Mary Frances Staples); died on 5 Mar 1941 in Fort Stockton, Pecos County, Texas; was buried on 8 Mar 1941 in Hamilton, Hamilton County, Texas.

    R. D. McCuistion, 51, pumper living on the lease of the Krupp-Flaherty Oil Corporation in the Lehnfield 24 miles northeast of Fort Stockton, was killed Wednesday when his car left the highway 8 miles northeast of Fort Stockton and overturned four times.

    Members of the exploration crews operated out of Fort Stockton by Robert H. Ray, Inc., arrived soon after the accident and found Mr. McCuistion barely alive. They placed him in their pickup and brought him to a Fort Stockton hospital, but he was dead on arrival there, apparently as a result of head and chest injuries.

    Mr. McCuistion came to Pecos County 14 months ago from Brownwood to work for the oil firm, stated Mr. Flaherty, who came from Midland Thrusday morning to aid with funeral plans. His wife Mrs. Effie McCuistion and a daughter, Miss Ella Mae, live in Brownwood and were enroute here Thrusday to complete funeral plans. Burial was tentatively planned in Hamilton, former home of the family, Mr. Flaherty said, "No services were planned here."

    A brother, A. E. McCuistion lives in Big Springs.

    The McCuistion car apparently went out of control as a result of a blowout. Veering into a ditch on the rightside of the road, and then out across the left, where it struck loose gravel and turned over 4 times. The car was demolished.

    McCuistion body was brought to Indian Gap to the home of his father-in-law, Tobe Spivey, where it remained until Saturday afternoon, when funeral service were conducted by Bro. O. O. O. Newton at the Pottsville Cemetary.

    Pallbearers were Elmer Hurley, Dick Hurley, Earnest Bryan, R. L. Spivey, and Orville Spivey.

    Flower girls were Georgia Marie Hurley, Meda Faye Simmions, Billye Lee Graham, Dora Spivey, Lena V. Landsey, Lucy Witizscher and Edna Harris.

    McCuistion is survived by his wife, a daughter, his father, six brothers and two sisters. One brother, R. T. McCuistion was only close relative present for the funeral. Other out-of-town relatives here were Mrs. W. M. Brooks of Wichita Falls, Mr. & Mrs. E. H. Bryan of Loraine, Mr. & Mrs. George Barton of Brownwood and Mr. & Mrs. Arl Spivey and daughter of Joinerville.

    Mrs. Effie McCuistion, 86, of Hamilton died Wednesday, January 16 in a Hamilton nursing home. Services were held Saturday, January 19 at the Riley Funeral Chapel. William Van Winkle and Chris Frizzell were officiating. Burial was in Pottsville Cemetery.

    She was a native of Hamilton. Born here on January 3, 1894 to the late Tobe and Sally Spivey. She was a nurse, wife and mother. She also was a member of the Church of Christ. She had lived in Hamilton for the past 21 years.

    Her husband Richard D. McCuistion preceded her in death in 1939. Survivors include a daughter, Ella Mae Kirk of Houston, five sisters, Ella Hurley and Talma Hurley of Hamilton, Essie Bryant of Fort Worth, Evie Brooks and Lula Elkins of Alney. One brother, Orville Spivey of Indian Gap. Four grandchildren and six great-grandchildren.

    Services for Effie were conducted at Riley Funeral Chapel by William Van Winkle and Chris Frizzil.

    According to his great grandson, Frances "was very religious. The people in town called him "The Jesus Man." He built rock fences down around Austin for forty cents a yard, and he was able to earn four dollars a day that way in the 90's when everybody else was only earning a dollar a day. He bought a section of land down there, but sold it in the early 1900's after losing his mother, father, brother and second wife - all between 1900 and 1905."

    Frank's great grandson Richard states, "he died in 1942 when he wouldn't let the doctors cut his leg off."

    Notes:

    Elisha and Lourana did not have any children. Elisha McCuistion was born in Tennessee, he moved to Missouri, and then to Texas in 1844, locating near Webberville, east of Austin. About 1856, he moved to Hays County, Texas, settling on Cypress Creek, a little above Wimberley. At the time, Wimberley was known as Cude's Mill.
