James, the settler, is the third of the group of Pennsylvania-North Carolina group. He first settled in Pennsylvania, and according to family tradition, lived in Pennsylvania before going to North Carolina. Tradition relates that the name was formerly spelled with a "Q" and was changed to "C" at the suggestion of Dr. David Caldwell. He was associated with the Nottingham Company or Colony. The Nottingham Colony was a group of people who came to the area from the Nottingham Presbyterian Church in Rising Sun, Lancaster County, PA; it was established in old Rowan County, North Carolina..

From the Guilford County, North Carolina Court Records: February 4, 1765, Jennet McCuiston, Thomas McCuiston and James McCuiston returned an inventory of the estate of James McCuiston, deceased, they being executors of the said James' last Will and Testament.
